Legionnaire’s outbreak results in fine - 07-08-2009

An outbreak of legionella bacteria at a Preston-based food processing facility that caused two employees to contract Legionnaire’s Disease has resulted in a £45,000 fine for the operating company, following a recent court case. The water supplies at Kepak UK’s Bamber Bridge premises were found by Health and Safety Executive (HSE) inspectors to contain ‘significant levels’ of the harmful bacteria in three separate locations, underlining the severity of the issue.

The company was fined £25,000 and ordered to pay £20,000 court costs, after the judgment at Preston Crown Court. The site has been closed for remedial works on the water system, including drainage and disinfection.

“Kepak failed to carry out simple checks on the hot and cold water system. As a result, many of its employees working at the site were potentially exposed to the legionella bacteria, and two individuals were made seriously ill,” said Dorothy Shaw, HSE’s principal inspector. “Any system containing water at temperatures between 20 and 45 degrees Celcius, and which may release an aerosol during operation or maintenance, is at risk of exposure to legionella bateria.”
